LawGeek Summary/Reaction

Summary:

This article is about how one of the authors friends photographs was used in a video and she was not credited with it in their video.  The author was trying to find out whether this was legal or not.  To find out if it was legal it had to pass the for criteria for fair use which are the purpose of use, whether the original work was published and/or fictional, the amount of work take and the potential to harm the market for the the original work.  According to these rules, a court would rule in favor of the video, making their use of the photograph fair use.  However, the author also was looking at if it was ethical for them to not credit her.  As internet users, when we use something that we didn’t create, the author believes we should credit them.  He wants respect for the artist and what they create.

Reaction:

I think that this is totally pointless.  These people who created the bubble video were trying to make something for everyone to enjoy not hurt Lane’s business.  It just happens that they used her photograph in their video to make a point.  It totally passes the fair use rules so they wouldn’t get in trouble if she took them to court and if she didn’t want people using her video she could have gotten all rights reserved and then they would need to credit her to use it.  If you don’t want people using your work don’t put it out where it can be taken and used without your permission.
